TERMS AND CONDITIONS FOR TICKET PURCHASES TO THE SAVE OUR MUSICIANS FOUNDATION (SOMF) DINNER GALA

1. TICKET PURCHASE AND DONATION

By purchasing a ticket to the Save Our Musicians Foundation (SOMF) Dinner Gala, you agree to these terms and conditions. Tickets to the event are secured through a donation to SOMF, a Florida 501(c)(3) non-profit organization. Your donation will contribute to the organization's mission to support and promote local musicians in need. All ticket sales are final, and no refunds or exchanges will be provided.

2. EVENT ADMISSION
A valid ticket is required for admission to the event. SOMF reserves the right to refuse entry or remove any attendee from the event premises for any reason, including but not limited to, disorderly conduct, intoxication, or failure to comply with these terms and conditions.

3. EVENT CANCELLATION OR POSTPONEMENT
SOMF reserves the right to cancel or postpone the event due to unforeseen circumstances or force majeure events. In such cases, SOMF will make reasonable efforts to notify ticket holders of the cancellation or postponement and any rescheduled date or alternative arrangements.

4. LIABILITY AND INDEMNIFICATION
To the maximum extent allowable by law, SOMF, its agents, employees, contractors, and all other representatives shall not be liable for any injury, loss, or damage, whether direct or indirect, consequential, or incidental, arising out of or in connection with your attendance at the event. You agree to indemnify, defend, and hold harmless SOMF, its agents, employees, contractors, and all other representatives from and against any and all claims, demands, losses, damages, costs, and expenses, including reasonable attorney's fees, arising out of or relating to your attendance at the event.

5. PHOTOGRAPHY AND RECORDING
By attending the event, you acknowledge and agree that you may be photographed or recorded, and you consent to the use of your image, likeness, and voice in any promotional materials, publications, or social media platforms by SOMF or its authorized representatives without any compensation or further notice to you.

6. GOVERNING LAW
These terms and conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these terms and conditions or your attendance at the event shall be subject to the exclusive jurisdiction of the courts of the State of Florida.

7. SEVERABILITY
If any provision of these terms and conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

8. ENTIRE AGREEMENT
These terms and conditions represent the entire agreement between you and SOMF regarding your purchase of a ticket to the event and supersede any prior understandings or agreements, whether written or oral.

9. DISPUTE RESOLUTION
To the fullest extent allowable by law, SOMF shall have the sole authority to resolve any disputes arising out of or in connection with these terms and conditions, your ticket purchase, or your attendance at the event. By purchasing a ticket to the Save Our Musicians Foundation Dinner Gala, you agree to submit any such disputes to the exclusive jurisdiction of SOMF for resolution, and you expressly waive any rights to ini1ate or participate in any class ac1on or representative proceeding against SOMF.

10. RAIN OR SHINE EVENT
The Save Our Musicians Foundation Dinner Gala is a rain or shine event. No refunds, exchanges, or cancellations will be granted due to inclement weather, unless the event is canceled or postponed by SOMF in accordance with Sec1on 3 of these terms and conditions. By purchasing a ticket to the event, you acknowledge and accept the risk of attending the event in inclement weather and release SOMF, its agents, employees, contractors, and all other representatives from any liability for any losses or damages arising out of or in connection with such weather conditions.

By purchasing a ticket to the Save Our Musicians Foundation Dinner Gala, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
